TERMS & CONDITIONS:
Miyaru Ocean Expeditions is a trade name of Nia Sharks Dive & Travel LLC, a Puerto Rico company (“Miyaru,” “we,” “us”). By booking an expedition, you (“the participant”) agree to these Terms & Conditions.
1. Booking & Deposits
A deposit is required to reserve your spot. Deposits are non-refundable.
Fuvahmulah Tiger Shark Expedition: USD 800
Maldives Freediving Liveaboard: USD 800
You may pay in full at booking, or pay the deposit and the balance through the payment plan offered at checkout.
The full balance is due 45 days before the expedition start date. Bookings made within 45 days of departure must be paid in full.
If the balance is not received by the due date, we may cancel your booking, and the cancellation terms below will apply.
All prices and payments are in USD. Card processing and currency exchange are handled by your bank, and refunds are issued in USD.
2. What’s Included
Each expedition’s inclusions and exclusions are listed on its page. Unless stated otherwise, international flights, travel insurance, visas, meals not listed, tips, and personal expenses are not included.
3. Cancellation by the Participant
All cancellations must be sent in writing to miyaruexpeditions@gmail.com. Charges are based on the date we receive your notice:
More than 90 days before departure: the deposit is kept (non-refundable)
90 to 46 days before: 50% of the total price
4o days or less, no-show, or leaving early: 100% of the total price (no refund). These charges reflect payments and commitments already made to our local partners (dive centers, hotels, and boats) as the expedition date approaches.
No refunds are given for missed days, late arrivals, or activities you choose not to join.
Transfers: If you can no longer join, you may transfer your spot to another person. The replacement participant must be provided at the time you notify us of your cancellation, must meet the expedition requirements, and must be ready to pay the remaining balance and complete their booking. Once the transfer is confirmed, the cancellation charges above will not apply.
4. Cancellation by Miyaru
Expeditions require a minimum of [4] participants. If we cancel for any reason, including not reaching the minimum, you will receive a full refund of all payments made to Miyaru. Personal costs will not be refunded, such as flights, accommodation outside the expedition, visas, or any other expenses booked separately.
5. Changes, Weather & Force Majeure
Ocean expeditions depend on weather, sea conditions, and wildlife. Itineraries, dive sites, and schedules may change for safety, and wildlife encounters are never guaranteed. We are not responsible for disruptions beyond our control, such as extreme weather, natural disasters, government restrictions, or travel disruptions. In those cases, we will do our best to offer alternative activities, and no refunds are given for activities missed for these reasons.
6. Travel Insurance
Travel insurance is mandatory for all participants. You must have dive accident insurance from DAN (Divers Alert Network). DAN is the only dive insurance we accept. Medical and trip cancellation coverage are strongly recommended. Proof of insurance is required before the expedition.
7. Participation Requirements & Waiver
All participants must be at least 18 years old, meet the requirements listed for each expedition, and sign our liability waiver before the trip. We may refuse or end participation if a participant’s health, behavior, or skills put their safety or the group’s safety at risk. In that case, no refund applies.
8. Third-Party Providers
Accommodation, dive operations, and boats are provided by independent local partners. Miyaru organizes and leads the expedition but is not responsible for the acts or omissions of these providers.
10. General
